These terms and general conditions apply to all Tekno offers and contracts.
A contract with a customer is considered completed the moment (the entire) order has been shipped to that customer. An order confirmation is sent by email, immediately upon shipment of the order. Any errors made in the order request are entirely at the customer’s risk and expense.
Payment must be made within fourteen (14) days of the date the order is placed. If payment is not received within seven (7) days, the item(s) ordered may no longer be available (for the agreed upon price). In this case, the customer will have to re-order the item at the new price. Claim of product defect by the customer does not suspend payment obligation. Items may never be purchased on credit.
Orders are usually shipped within 4 working days after payment has been received. In the unlikely event the item ordered is no longer available, Tekno reserves the right to ship an item similar in price and quality, or to issue a buyer credit note for the amount paid. In case of late delivery, we must be notified in writing. Notwithstanding the aforementioned exceptions, we retain the right to deliver the item within fourteen (14) days, during which time the customer must accept delivery of the item. Once the item has been delivered to the customer, all risks and responsibilities transfer to the customer. In cases where the item cannot be delivered to the address provided by the customer, the item will be delivered to the post office, at which time all risk and responsibility is transferred to the post office. The maximum time allowed for delivery extends to 30 days in this case, unless otherwise agreed. If it is agreed that this form of delivery is not feasible, the customer retains the right to cancel the order, or request a new delivery.
Shipments are at the risk of the buyer. Tekno is responsible for the choice of shipment method and packing. According to Dutch law, the moment of delivery is the moment the item leaves our company. Tekno retains the right to make partial deliveries.
All prices are listed in Euros, and include VAT. All prices are subject to change. Tekno cannot be held responsible for typos or other errors in the price list.
The buyer is obliged to inspect the goods upon delivery, and to report any defects to Tekno immediately. Claim of defect must be made within 7 days of delivery of the goods to the customer, preferably in writing. If we do not receive report of defects immediately, we consider our obligations to be fulfilled, and can no longer be held responsible for product defects. If a complaint has been received within the time allowed, and the item(s) delivered does/do not meet the agreement, the buyer can choose to have the goods replaced (at our expense) or to receive a credit note. 8. Return Policy
The buyer has the right to cancel the order within seven (7) days, without explanation. The goods must be complete, undamaged, unused and in the original packaging to be returned. The shipping costs are the responsibility of the buyer. Tekno will return payment of the item(s) to the customer within 30 days of receiving the goods.
All our agreements are subject to Dutch law. Any disputes which cannot be resolved will be taken to court to be resolved in accordance with the rules of Dutch law.
10. Extrajudicial collection costs
If Tekno incurs legal costs due to a customer’s breach of contract, the buyer will be obliged to reimburse Tekno for the total amount.
11. Force Majeure
Tekno’s responsibilities will be suspended in the case of a force majeure (if affected by influences which are outside its control, such as natural disasters, which could not be evaded through the exercise of due care). If the force majeure lasts for 14 days (or more), both parties have the right to dissolve the agreement by written notice without any loss or compensation. The circumstances of a force majeure may include strikes, lockouts and delay, or other problems with suppliers and/or government actions which affect Tekno. Action will be taken as soon as possible to ensure that all parties are kept informed.
Tekno’s guarantee does not extend further than the guarantee offered by third party suppliers, with regard to third party products. If damage results from improper use, or other influences beyond Tekno’s control, the guarantee is considered void. The guarantee never extends to cover medical expenses or the cost of damages caused by use of Tekno products in ways which were not intended. Tekno models are guaranteed only as models, and nothing else.
Tekno will not be held liable for any damages caused directly or indirectly by Tekno products. The customer will not involve Tekno in any third party claims. Tekno will be liable for no more than the amount shown on the invoice, or the amount Tekno charges the customer. This limited liability applies to employees, and all others affected by the purchase agreement.
14. Other provisions
In case any individual provision contained in this document should lose all or part of its operation, this will not affect the validity of the remaining provisions and their terms.
